custody. plus a safeway employee fired after using a homophobic slur. does it amount to a hate crime? a top prosecutor weighs in tonight. . when life gives you lemons, make lemonade, just don't sell it near the u.s. open. why some kids trying to sell it for cancer patients learned that the hard way. we begin tonight near bristol, virginia where a 2- year-old boy of found dead. the child was found unresponsive in his family's minivan this afternoon in the 12000 block of gentle shade drive. we have a crew gathering information, the latest details as soon as we get them, we will, of course, pass them along. a virginia community is stunned tonight after an all day fbi search of a home in whacky andrea. a man who lived -- in al ex andrea. a man who lived in the house set off -- in alexandria. a man who lived in the house set off a security scare today,

yonathan mela could. >> reporter: we are learning more about this young man -- melaku. >> reporter: we are learning more about this young man tonight. neighbors tell us he had been frustrated because he could not find a job. he had been on a waiting list to get a license to drive his father's taxicab. last month he was arrested and charged with vandalizing cars in to run county, but until then that was the only time he'd been on anybody's radar until now. about 8:00 tonight the fbi pulled out of the alexandria neighborhood of the mannen detained in the pentagon -- man detained in the pentagon scare. for hours investigators went over his townhome looking for clues of suspicious behavior of this man, 22-year-old yonathan melaku, a marine reservist. the whole thing has his neighbors stunned. >> it's scary. i know these people because i was on the hoa committee, so i knocked on each door and i met the young man once.

>> reporter: in the wee hours of the morning police took mall a cue into custody fortress -- melaku for trespassing for trespassing in arlington cemetery. they found a notebook with the words al-qaeda and taliban. police say the alexandria man was uncooperative. >> in the course of interviewing this person the united states park police felt it was appropriate to look for a vehicle this person may have been operating. >> reporter: officers found his red 2011 nissan parked in a wooded area near the pentagon and called in the bomb squad to check it out. as a precaution they shut town roads around the pentagon snarling traffic for hours. after hours of investigating the fbi said it's believed he acted alone and that there were no other public safety issues, but all the goings on have some of his neighbors on edge. >> add two and two. don't know what the hell's going on, but when you walk by, a lot of people get very nervous. >> reporter: we are told he is still in the custody of u.s.

park police tonight detanned for for trespassing. we -- detained for trespassing. all the items in his backpack are being processed in the fbi lab. >> so was reaction to the scare today overkill? homeland security expert joshua filler joins us now to break it down. thanks for coming in tonight. >> thank you. >> as they say, hind side is always 20/20, but in -- hindsight is always 20/20, but in light of everything, did authorities respond appropriately or was it overkill? >> no. i think they acted appropriately under the circumstances. as you said, this was the pent gob, the target of 9/11 -- pentagon, the target of 9/11. it remains a primary target of al-qaeda and given the fact that this individual was uncooperative and ran from the police i think they had to act with an abundance of caution. >> not to mention they reportly found a notebook with the words al-qaeda and taliban written on it. just curious do, you think when we see responses to these sorts

of incidents is it out of a fear of retaliation from al- qaeda for the death of osama bin laden bin? >> that's always a possibility, but this is still an ongoing investigation. so we don't know exactly who this individual is, why he did what he did. it may have nothing to do with terrorism, but right now it's an open investigation and we'll learn more in the coming days and weeks ahead. >> from the homeland security perspective are we seeing more home grown terrorists? are we seeing people who are going out on their own? what's the buzz right now? >> well, homegrown terrorism has been an ongoing problem for years now. we've seen it all over the united states and the fact is that al-qaeda has been trying to get american citizens, immigrants and others to basically take up arms against the united states acting as lone wolves or in concert with others. so it is an ongoing and growing problem. >> earlier this week a woman threatened to blow up a metro train she was riding. passengers started climbing out the windows, going across electrified lines to get away.

people in this region are understandably scared. will there ever be a point d.c. won't be on this sort of alert? >> well, that's the ultimate question. how long is this going to last? unfortunately it's probably going to last a very, very long time, but eventually i do think that this kind of threat and these kind of organizations like al-qaeda will ultimately be discredited, but it is going to take some time. >> joshua filler, thank you tonight. >> thank you. want to get back to our breaking news off the top tonight in bristow, virginia. a 2-year-old boy found unresponsive inside his family's minivan this afternoon. you know how hot it was today. matt ackland is live in northern virginia with the latest. what do you know, matt? >> reporter: yeah, brian. this is a terrible story. let me tell you what police just briefed us on not too long ago. apparently around 4:00 today a mother goes out into her driveway to her minivan and finds her 2-year-old boy in the back seat still strapped into his car seat. she screams and then a neighbor

runs over. we have some video of the house. the neighbor just happened to be a retired police officer. apparently he tried to do some cpr on the child but a short time later once the ambulance got there and they got to the hospital the child was pronounced dead. now a question that i had for police and they're still trying to determine this at this point, was it heat? were the windows rolled up all the way? the one sergeant i talked to said when she got there, the windows were up, but it will be up to a medical examiner to determine exact cause of death, but definitely the heat. it was hot here. that is what authorities are looking into right now. >> you know, we're talking to everybody and doing our forensic examination of the crime scene and the van and there will be an autopsy and then we'll confer with commonwealth attorney and decide whether or not charges would be appropriate and if so, what charges would be appropriate. >> reporter: ryan murphy is the

2-year-old boy's name. authorities just released his name to us not long ago. we are told the mother was here at the police station behind me talking with investigators and as you heard, it won't really be up to police to make an arrest. they're going to leave it up to the commonwealth attorney and, brian, at this point authorities believe this was just a terrible accident. back to you. >> matt ackland tonight. questions this evening over whether an incident at a local safeway last week warrants hate crime charges for a store clerk. she was fired after using homophobic slurs against two gay customers last saturday at a safeway in southwest d.c. the customers were putting their groceries on the conveyor belt when the clerk called them the f word, not once but twice. safeway let the clerk go four days later after being pressured from a city council member. d.c.'s county attorney addressed the incident on wtop radio today. >> if somebody commits a crime and it's motivated by buy, we prosecute those -- by bias, we

prosecute those and by a bias enhancement. actually hate crimes have been up on individuals based on sexual orientation. >> the store is said to be conducting an internal investigation. three teenagers tonight under arrest accused of vandalizing a montgomery county high school with hate language. police say the teenagers spray painted swastikas, kkk and other slurs on the walls, windows and a basketball court at poolesville high school. the teens are accused of stealing a utility vehicle from the storage building. the 14 and two 16-year-olds were charged and released to their parents. >> i hope we don't get caught in this without an umbrella. one of our photographers shot this video as the rain came pouring down in springfield, virginia. as he headed back to the station, the skies suddenly parted, cleared up, double rainbow appeared. gary mcgrady is in the weather center with your first look at the forecast. gary, we're all over the board. >> those are rare, too, those

double rainbows. listen, no longer any storms out there this evening. we go over to true view they've calmed down just about mainly 9:00 everything really began to calm down out there. i'm not seeing anything back to the northwest either. we broadened the view a little bit. there are a few thunderstorms way up in ohio, but those should begin to weaken as they get closer to us over the next few hours or so, so not really expecting any problems overnight tonight. temperatures, though, have cooled this evening with the rain moving through. it's just nice out, 73 here in the city, dulles 70 and frederick 70 degrees. now temperature won't cool much more here in town. we're just talking a few clouds overnight, but out in the suburbs a little bit of a treat as temperatures drop down to the lower 60s overnight tonight, full forecast, weekend, father's day, lots of stuff going on this weekend. we'll see if the weather wants to cooperate. >> thanks, gary. congresswoman gabrielle

giffords is heading home to tucson this weekend to visit her family. it will be her first visit to arizona since she was shot back in january. giffords' husband mark kelly said his wife misses tucson and doctors believe a return home will be good for her recovery. two days ago giffords was released from the rehab hospital in houston where she's been undergoing treatment. aides say she will not make any public appearances. the u.s. open isn't the only golf game getting attention this weekend. so is president obama's pairing with republican house speaker john boehner. the two leaders will hit the links tomorrow expected to play at one of the military bases around here the president usually plays. it's expected the president and boehner will find time to discuss some important issues besides their golf swings. >> this is an opportunity that i think has value. i think it has great value beyond the game. >> vice president biden and ohio governor john kasich will join the president and boehner. reporters asked if they'll get a chance to see the final

a lemonade stand near the u.s. open in bethesda is open for business but it was touch and go earlier today after the county threatened to shut it down. some local kids set up the stand to raise money for cancer patients. fox 5's audrey barnes is here

to explain what happened. >> these neighborhood kids encountered more hazards trying to keep their stand open than the golfers did on the course. montgomery county officials have now had a change of heart. >> ice cold drinks. >> reporter: a lemonade stand is a rite of passage for a lot of kids, but these kid trying to set up on private property outside the u.s. open were told they'd need a permit. >> we did try to contact the county and get a permit, but we were told that we could not get a permanent and that even if we wanted the kids to give the lemonade out for free and then take contributions for the charity, that that would also require a permit. >> reporter: during their third visit the county slapped a $500 fine on the parents and threatened to take everything down which left 10-year-old christian at a loss for words. >> i was very upset. i got just -- i just got upset railroad andrew says he can't understand how raise --

>> reporter: andrew says he can't understand how raising money for kids with cancer can be a bad thing. >> it made me mad and angry. >> reporter: the county refused to back down saying it was no longer a permit issue but traffic safety. the kids were told their stand at persimmon tree road and country club drive was distracting drivers. >> i just think it was a lack of common sense. i really do. you know, regulation gone a little hay wire. >> reporter: late in the day county officials had a change of heart. if the kids could move back from the main road, the stand could stay open and their parents wouldn't have to cough up the $500. >> now we can go on and keep selling lemonade for the next couple of days. >> make a lot of money for kids with cancer, right. >> yup. >> reporter: and that stand really struck a chord with a lot of people heading to the tournament. one man gave the kids a $250 check in honor of his niece who is battling cancer and the kids say they'll be serving cold drinks out there all weekend long and all the proceeds are

going to the just trying it charity and we'll put a link to that on our website, www.myfoxdc.com. >> good for them. what was the county thinking? let the kids sell the lemonade. it all turned out well, thank you. with or without lemonade it was a record setting day at the u.s. open. fox 5's lindsay murphy joins us now from the newsroom. tell us about the day rory mcilroy had. >> this was a day every golfer dreams of and ian poulter said it well when he said mcilroy's performance of tiger woods of 11 years ago. the 22-year-old became the first player in the 111 year history of the u.s. open to reach 13-under par. mcilroy played 17 holes before he missed the green. he didn't bogey until his 36th hole, pretty impressive, but first we'll start with a fan favorite, phil mickelson looking to rebound after yesterday's 3-over 74. this is phil on no. 14. he can move teen par on a

birdie and he's -- to even par on a birdie and he's right on target. as we said, all eyes today on rory mcilroy who led after the first round with a score of 6- under par, now at 8-under on the 8th, his second shot goes behind the flag about 15 feet. this is when you know you're living right. the ball slowly roll down the slope but as if there's a magnet in the cup it falls for an eagle. that moves him to 10-under. mcilroy's only misstep was a double bogey on 18. the 22-year-old finishes at 11- under par, a new 36 hole record at the open. >> i'm very happy with the way i'm swinging, happy with the way i'm hitting it and as i said, last night i feel very comfortable on this golf course and there's no real keys as to how i've shot so well or went so low. i just keep trying to hit it in the fairway and hit it on the green and try and hold a few putts and i've been able to do that. >> today's second round was

suspended by darkness. 21 players have to complete today's round tomorrow morning before then starting round three. let's hope mcilroy can pull it off. >> it's fun to watch. thanks, lindsay. the city paper is trying to end its dispute with redskins owner daniel snyder asking a judge to dismiss the defamation lawsuit. a spokesman said the paper -- for the paper says the lawsuit has no merit. the so-called anti-slap law was designed to protect news organizations against lawsuits intended to intimidate them from writing about public figures, no word when the judge will make a decision. nfl fans have reason to be concerned about the upcoming football season needless to say. next week league owners get an update on the latest negotiations with the players. they're prepared to stay an extra day due to the complexity of the proposals on both sides. 24 of 32 owners have to agree on any new collective bargaining agreement, but owners already familiar with the proposals don't seem ready to make a deal. the end may not be in sight

just released court documents are revealing new details about dominic strauss- kahn's arrest. the former imf chief is accused of trying to rape a maid in his hotel room taken into custody at kennedy international airport as he tried to leave the airport. documents say he asked if he needed an attorney and repeatedly asked what is this about and declared he had diplomatic immunity and complained about his handcuffs.

strauss-kahn maintains he did not attack the maid. he is under house arrest. a college football player was forced off an airplane and arrested in a dispute over his saggy pants at the san francisco airport. the university of mexico student said he was boarding an airlines flight when he was asked to pull up his pants. marmon refused and when he refused, the pilot called police. >> they told him to step off the plane and he refused and that's where everything kind of got blown out of proportion. >> a passenger on board the aircraft had walked on with his underwear showing. so he explained that his pants were down below his crotch and that he refused to pull his pants up and the captain wanted him off of the aircraft for being disruptive. >> his mother says he was still upset after attending the funeral of a childhood friend. drama and the casey anthony trial seem to go hand in hand these days.

[ fighting ] the tempers were flared this morning outside the courtroom for the casey anthony murder trial. a fistfight broke out in the crowd waiting in line just to get tickets to see the trial. police rushed in, stopped it, did not make any arrests. meantime inside the courtroom the defense worked to convince the jury of casey anthony's innocence. today's testimony focused on the smell coming from anthony's car and whether or not it came from her daughter's decomposing body. fox's gloria gomez has more on the testimony from orlando. >> do you swear or affirm to tell the truth, the whole truth

and nothing but the truth. >> reporter: looking to poke holes in the prosecution's case the defense called a bug expert to say the insect activity in casey anthony's car trunk did not show signs of decomposition. >> i did include the opinion that there is no evidence of a decomposing body associated with the insect bugs. >> reporter: that contradicts the prosecution's expert saying the buck activity showed signs of decomposition. that's important because prosecutors say little caylee was rotting in the trunk for days while casey anthony enjoyed the good life getting tattoos and joining hot body contests, but the expert claimed there were not decomposing stains in the car trunk. >> it's completely outside of their expertise. he's an entomologist. >> reporter: the prosecution lost that battle but had h their way eventually with this -- had their way eventually with this witness.

>> you would also agree with his conclusion that the evidence is consistent with the body being deposited there in june or july of 2008, correct? >> it's consistent with those dates, yes. >> reporter: under fierce cross- examination dr. tim huntington actually confirmed the prosecution's timeline, that the remains were moved two to three days during decomposition. the state also gets dr. huntington to acknowledge when he examined the car a full two years after caylee disappeared the trunk still had the odor of death. >> when you viewed the trunk july 2010, it still smelled, didn't it? >> there was a smell in the trunk, yes. >> reporter: gloria gomez, fox 5 news. >> the bug expert was the only witness to testify today. the trial continues tomorrow morning. the daughter of john is edwards is not letting his legal troubles distract from honoring her mother's memory. kate edwards recently left the washington law firm where she worked to start the elizabeth

edwards foundation to carry on elizabeth's work in education and mentoring. ely beth and john edwards created a -- elizabeth and john edwards created a computer learning lab in honor of their 16-year-old son killed in a car crash. now that anthony weiner resigned, the question remains who will replace him? a special election will be held to fill the seat. whoever is elected may not be there long. new york is losing two congressional districts because of population shifts. it's possible weiner's districts will be eliminated. sarah palin is adding her two cents to the anthony weiner scandal. one day after his resignation palin said weiner should have quit as soon as the first racy picture went public, but wait till you hear how she described weiner's problems. >> anthony weiner from henceforth after his personal indiscretions were close was going to be rendered impotent basically in congress and wasn't going to be able to be effective. obviously it was the right thing to do, a day late, dollar

mainstream media to the same account he holds fox news. >> to that point do you think and pun intended this issue with anthony weiner cut to the heart of the criticism against jon stewart, which is that he likes to hold people's feet to the fire but he can hide behind being oh, i'm just a comedian kind of thing and a lot of that masks what i think people perceive as his liberal bias? >> absolutely we're going to get into that because that is frankly his dodge. i think he's funny. i enjoy watching him, but i do think when he's pressed, his tendency is to say listen, i'm a median. i'm just trying to make jokes. it's just that most of the -- comedian. i'm just trying to make jokes. it's just that most of his jokes are about the right. he seems more at pain when he has to make jokes about the left and we'll talk about that. >> you have outgoing robert gates this weekend. >> he's stepping down at end of

going for about 93 bucks. prices have not been this low since february. the cheaper oil leading to cheaper gas. general motors revving up plans to create or save more than 160 jobs. the maker of silverados and corvettes says it will spend $65 million to update a couple of plants in new york and tennessee. by the way, that's about $400,000 per job. meanwhile the international monetary fund is lowering its forecast for u.s. economic growth for not only this year, but also for next year. the imf warning d.c. it is playing with fire on the debt, but there's some good news for dear old dad this father's day weekend. families expected to sell out more -- shell out more than $100 on average to show pop some love. the national retail federation says that's the most in its eight years of tracking father's day spending. that's business. i'm liz macdonald. did you see it? a couple of rats making themselves at home at the white house. the rodents were caught on tape scurrying across a wooden plank in a construction dumper it. workers were making repairs on the -- dumpster. workers were making repairs on the north driveway. one rat claim climbed a plank and phelps. the other guy -- climbed a plank and fell. the other guy didn't have much trouble. take a look at daisy the cow opening up the stable gate with her tongue. her owner had surveil camera installed after his cattle -- surveillance cameras smalled after his cattle kept getting out at nighttime.

in tonight's consumer alert what some people are calling the death of blackberry. the company's maker of research and motion in s no. 3 in the smartphone market. -- is no. 3 in the smartphone market. quarterly earnings failed to meet expectations sending its stock tumbling 21% today, its lowest level in five years.

now r.e.m. was worth eighty billion dollars three years ago. it's now worth less than 15. tech expert nick simmons is here to help us break down the future of blackberry. i think at one point blackberry was it. from capitol hill to the white house everybody had a blackberry. even the president couldn't live without his. now there are pictures of the president with his ipad tucked underneath his hand. white house staffers are reportedly using iphones and ipads. i made the swkicking myself for waiting so long. why are people suddenly making the switch from blackberry to androids and iphones? >> i think one of the biggest thing are people are excited that the iphone and android are more multi-media devices. they're great for doing social media, videos, something that blackberry is starting to catch up on now. >> what other sort of things? i mean what makes android and iphone so much superior to the blackberry, so to speak? >> for starters they've got thousands of more apps available to them. so there's a lot more games available, a lot more content

that's unique to just those platforms. the screens are more vibrant and they're better for the multimedia. >> we put this question to some of our friends on facebook a short time ago and we asked them what they were thinking of this. alan ashmore says that's why it's called a crackbare, but joe webster says no -- crack berry, but joe webster says no. blackberry cannot bounce back from that. they've gone from innovators to followers. is there anything plaque bare can do to compete? >> they -- blackberry can do to compete? >> they still have a strong market in the corporate world. i think over the next year or so they can get more market share back into the smartphone area. >> i think it sounds like you're saying experts are prematurely predicting blackberry's demise. will they ever gain that footing again in this market? >> it's definitely not going to be easy. i think blackberry definitely can do it. they should be able to bounce

away from those thunderstorms, but the temperatures have cooled on down. wonderful picture out there of the monument tonight. where you did get the rain, it was heavy. there was also a lot of wind in those thunderstorms tonight and a lot of hail reports coming down from culpeper where they had hail the size of some golf balls out there. most of it was marble size to penny size, but they did have some right there approaching golf ball limits down in culpeper as we watched some very strong storms move through there. nothing like that is going on right now. this is a loop that takes us back to about to 7:00 and the showers quickly moving through off to the east and southeast. there is a little bit more in the way of thunderstorms well back out to the northwest. we'll be addressing that coming up here shortly as we look at the bigger radar picture. highs today before the storm settled in for reagan national 87 degrees. you may have thought it didn't feel like that, but it did

briefly get up there. dumb less was -- pardon me, i have -- dulles was -- pardon me, i have these switched. it should be dulles 85 and bwi marshall 87 degrees. we're back into the upper 80s tomorrow, a little bit warmer but not much. 73 in town. gaithersburg cooled down to 66 there, manassas 68. you can see the other temperatures here coming in generally in the 60s and lower 70s. it's not going to be a washout of a weekend. if you like today, you'll like tomorrow and you're probably going to like sunday, too. all three days here high temperatures of 89 degrees. it will be a little bit more humid and i think the humidity not so much tomorrow, but the humidity does come back for father's day it's looking like and on into monday and tuesday and wednesday the humidity levels will be high enough i really think you'll start to feel it. so we've got these showers and thunderstorms moving out of here. we're pretty fair out there now, but look back to the northwest. there's an area of

thunderstorms coming out of ohio. it's about to come into west virginia and it's looking like that's going to begin to form a little bit of a complex. when that happens, it will generally ride along basically the contours of the temperatures physical basically it looks like this should dive down through west virginia and then move more into western and southwestern sections of virginia. so even if that forms into a larger complex of storms, it does not look like it's going to make a beeline here and hit from northwest down to southeast. so it doesn't -- i don't forecast these thunderstorms to come through tonight and wake us up with 2:00 in the morning thunder. that should stay away. we'll get some clouds from it i think by tomorrow morning and that's what futurecast is showing. this is tomorrow morning at 8 a.m., not clouds for everybody. we'll have some sunshine, but we'll have a little cloudiness to start which will quickly burn off and here we go again with some showers and thunderstorms popping up. you can see the green here.

a shower here, thunderstorm there scattered about, widely scattered and then as we progress through the evening hours later tomorrow night we may have a few more. this is showing primarily down to the south. i think we could even have a little bit lingering around north of the metro. overnight tonight thunderstorms are out of here, a few clouds, cooler out in the suburbs. we're talking lower 60s out there. tomorrow pretty much a repeat of today, a few afternoon showers and thunderstorms, heavy rain again with a little bit of wind and potential hail in those thunderstorms for tomorrow. some could be strong, maybe even approaching severe limits. we'll do it all over again on father's day. we'll do it all over again on the day after father's day, which is monday and then all over again on tuesday and you can see how temperatures basically stay in the upper 80s, lower 90s for the next several days. i think by thursday, friday of next week we may flirt briefly with the middle 90s. don't hold me to it, but it may

happen. >> all right. we won't. thanks, gary. still no end in sight to the misery being caused by the rising missouri river. the river busted through some of the levees designed to hold it back and is now threatening states from dakotas to kansas. in hamburg, iowa, national guard troops are working together to stage comebacks and using sandbags to try to keep their town flood-free. arizona continues to burn. stubborn wildfires are charring massive areas and the wind is adding fuel to those flames. fox news correspondent adam housley followed governor jan brewer on a tour of the damage. >> reporter: more mandatory evacuation orders for arizona residents this, time in the southern part of the state. >> we're being evacuated. we had to move. i have a rescue and got most of the dogs out yesterday. >> reporter: the monument fire burning since sunday in arizona's coronado national forest has destroyed at least 40 homes and structures. as crews are working to gain the upper hand it burns within miles of sierra vista which has

a population of 40,000 people. that means hundreds are forced to vacate their homes for safety. >> with the wind direction changing and the speed picking up we don't know which way it's going to. go. >> reporter: the monument fire is just one of two major fires burning as arizona's governor jan brewer get a firsthand look at the extensive damage. >> i just got a declaration for the emergency for the fires down there. >> reporter: in the northeast of the state near the border with new mexico thousands are fighting the giant wallow fire now bigger than the city of phoenix roughly 1/3 contained. it's the largest in arizona history. >> they'll get control of it and we hope they do that really soon. >> reporter: firefighters are also telling hundreds in the little town of eagar who evacuated once to prepare to leave again, if necessary. >> my heart sinks for everyone that went back and i'm glad i wasn't gone back yet. >> reporter: wind is the big culprit now that's returned to the region along with red flag conditions which means higher temperatures, very low humidity and wind gusts which could reach in excess of 40 miles an

there's no love lost between food trucks and restaurants in d.c. but today a barbecue truck parked next to a restaurant that was also serving barbecue, but this time they were working together to benefit some very deserving people. fox 5's beth parker explains. >> hey, how's it going? >> reporter: they are lining up not just because they're hungry, but hungry to do something positive. >> good lunch and also a good proceeds. >> reporter: this is old smoky, handmade by frank jordan, a disabled vietnam veteran. >> he has a broken neck, a broken back. he was paralyzed for three years. >> reporter: jordan is a welder by trade. >> he built this smoker train to try to supplement his income. it took him two years. after he completed building it he realized physically he would be unable to operate it and so he didn't even have internet service. his friend put it on ebay. >> reporter: stephen adelson
